Whatever it is, she deserves twenty years in prison, and she’ll probably get a fine.

Elizabeth Sunde, 26 (09.26.86), 8037 Gables Commons Drive #127, told investigators that she was approached by five or six “French men” in her apartment…

First, what we do know about her. She was born on September 26, 1986. She’s 5 foot 4 and 140 pounds. Her address was:

Sickeningly, if I’m reading her inmate record, correctly, she can be out with only $500 bond.

She’s a slut. That’s clear. She had sex with four men. From the videotaped evidence she enjoyed it.

Much, much worse (Elisabet’s private life, after all, is her own) is that she cried rape. Some people believed her. Fortunately, skepticism and video-taped evidence won the day.

For attempting to ruin the lives of several young men, almost nothing will happen.

The most horrible part is the lack of punishment she’s facing. If we are to believe the Orlando Sentinel‘s account, she’s been charged with of breaking Florida State Statue 837.05(1)

(1) Except as provided in subsection (2), whoever knowingly gives false information to any law enforcement officer concerning the alleged commission of any crime, commits a misdemeanor of the first degree, punishable as provided in s. 775.082 or s. 775.083.

And Florida State Statute 837.06

False official statements.–Whoever knowingly makes a false statement in writing with the intent to mislead a public servant in the performance of his or her official duty shall be guilty of a misdemeanor of the second degree, punishable as provided in s. 775.082 or s. 775.083.

Misdemeanors. She may get more from getting arrested while carrying marijuana.

A fellow blogger makes a good point:

Women who make false charges of rape should face the same harsh penalties as a man accused of rape, and she should have to register as a sex offender. She should also have to inform every man she dates or has sexual relations with that she has made a false charge of rape in the past; if she fails to do so it would mean a mandatory life sentence without parole.

Elisabet Sunde is a sexual predator. The law should treat her like one.

Just like Sharon Irons should be.

  1. This is the first I've heard of a false-rape accuser actually being prosecuted. Women lying about this happens frighteningly often. (http://www.ncfm.org/FACT1.HTM) Being publically accused of rape carries a thousand times more stigma in today's America than being raped does. It's hard to imagine something causing more psychological, emotional and sexual trauma than being raped, but being falsely charged and convicted of rape would have to do it.

    I never thought of the solution of charging false-rape accusers as sexual predators. It makes perfect sense to me at least. I don't really need to know most of the statutory rape offenders, but having photos of the false-rape accusers living nearby would be invaluable.

  2. Yesterday was a big day for Elisabet Sunde,

    She was fined a “derp fee” of $40, and received a public defender. She was bonded out by MacDonald Bail Bond [1], so she's free again. Her next court appearance is her arraignment at room 4-D at 1:00 PM on April Fool's Day. This is confirmed by that she no longer appears in OC's Current Inmate Database [2].

    What really, really bothers me is that, if the Orange County Clerk of Court's website [3] is accurate, she's not charged with the false report. While the news said she would be (they also spell her name as “Elizebeth,” heh”) the only charges against her are ” POSSESSION OF CANNABIS

  3. Cases like these are indeed frighteningly common. I should know; I've defended dozens of them.

    I had one where a woman accused six men of raping her. The security camera video later showed her hanging on them on the way up the elevator. That one got dismissed. In another, the alleged victim claimed that the accused had pursued her despite her telling him repeatedly to avoid him, and that he later snuck into her room to do the deed while she slept. I later found six witnesses who testified that they were dancing very suggestively at a unit party, and for a considerable period of time, just an hour before the alleged rape (she denied this under oath, of course). Her own testimony proved that she wasn't so drunk that penetration wouldn't have woken her up. Acquittal. In one case I refused to prosecute, a woman claims that seventeen successive dates each ended in rape. Same guy. Many more cases like that — I could just about go on all day.

    What scares me? First, that women making false accusations can be extremely convincing. The emotions can seem absolutely genuine up to and including the moment they're exposed as liars. New prosecutors (and I speak from experience) may believe them. Second, some defense attorneys may be demoralized about the initial appearance of credibility in the accuser, and as a result, may not dig for the facts to exonerate their clients.

    There are real rapes, of course, but they're inevitably either stranger rapes — with some evidence of actual force or threats of force — or acquaintance rapes where there is evidence that the victim resisted, or was genuinely too drunk to resist. Cases where intimidation is alleged are tougher. The ones to distrust are acquaintance rapes where she claims force, but there's no sign of a struggle and the neighbors didn't hear any screaming. Or the cases where she claims that she was too drunk to resist, but the BAC readings and eyewitness testimony suggest otherwise.

    To the extent that civil law should represent “private Attorneys General,” that is of course fine. However, I assume that in practice this seeks to further reward predators such as Elisabet. It is a reminder that not only should the law fully prosecute such false-accusers, but that action should be equally encouraged in the civil court arena.

  5. OK, I'm just taking a shot in the dark, but I guess you don't like Elisabet Sunde all that much….or is it just me? I was horrified when this story originally came out, the rape that is, because it was horrible to see such a thing at a place like Disney, which is sort of a bastien of innocence. But to see she faked it was even worse. I'm not ready to lock her up and throw away the key, and I'm certainly not ready to publish her home information to the world so they can go pelt her with rocks and anything else that's hard, but she is horrible, horrible, and I hope she realizes how bad her actions were.

    One note: the worst victim here certainly wasn't Elisabet Sunde (I don't know if she were a victim at all), and it wasn't the 4 guys; it was all the women who file real claims of sexual abuse and will have to go throgh even more scrutiny and disbelief when trying to plead their case the next time.

    Why not?She deserves severe punishment and ostracism. By the way the reason for publishing her home address in the sexual offender database would fit perfectly within the rationale for making the neighborhood aware of her presence.

    If males know what she has done, providing them with the information will allow them ample opportunity to avoid having any sexual relationship with her simply out of self-preservation.

We imprison pedophiles and then closely monitor them out of concern for the innocent. The post-release conditions on pedophiles aren't even considered punishment as such, whether than social protection legislation.

    That said, women like Elisabet Sunde are closer to rapists. Indeed, it's hard to see how what she did is not on par with rape (accept, of course, rape rarely involves years-long confinement in prison).

    I'm skeptical of scottage's claim on the identity of the “worst victim.” Would the worst victim of an actual rape be all non-rapists male — or the women who was actually raped? Spreading victimization throughout the land doesn't seem too productive.

    PS: The two misdemeanor offenses of ” FALSE REPORT TO LAW ENFORCEMENT AUTHORITIES ” and ” FALSE OFFICIAL STATEMENTS ” now appears on the Orange County Clerk of Courts site. That page is “in jail” for status, but her drug charges page shows “bonded.” Consider that the jail's website doesn't have her as a current inmate, it's probably safe to say she is free.

    There is actually a good Supreme Court precedent on point.

    CONNECTICUT DEPARTMENT OF PUBLIC SAFETY et al. v. DOE, (2003) [Upholding publication in the CONNECTICUT sex offender registry containing registrants' names, addresses, photographs, and descriptions against a procedural due process challenge, reasoning that the offender has no right to individual determination of the fact of dangerous– not material to the statute].
    Smith v. Doe (2003)[Rejecting contention that lifetime mandatory registration in sex offender registry was punitive for purposes of the ex post facto clause]

    Granted, the factual settings of Smith and CDPS are different in that they concerned with the constitutionality of sex offender registries, but nothing in the court's reasoning would preclude a legislature from extending — even retroactively — the registry to cover more offenses. Outside the punitive context, all the law would have to meet was rational basis scrutiny — could the legislature have concluded that posting the name and home address of Elisabeth Sun was rationally related to a legitimate government purpose.
    And the answer is clearly yes, even if society discriminates against a particular class of offenders.

  9. As the onerde members of the blog is discusing what Elisabet Sundes name mean in German. They have to remember that she is from Norway and it means noting like “sin” it that language. The meaning of her last name is like a small fjord between two mountains. And her first name is writen wrong in the police report is just like youre americans ought to do in youre way or no way.

    We don't put people that need help in prison or the Betty ford. We do give them prof. help. And yes she is back in Norway, so she dosen't need to come back, to youre country to get punished. The US's laws dosen't mean anything here.

  10. It's disturbing to hear that Elisabet is planning to skip out on bail. Hopefully, the resulting hassles should keep Americans safe from her. No such easy solution for sexual predators in general, though.

    I don't think a pedophile caught in Bangkok could use the same defense (“Imagine to being in a strange country, doing strange things, and not knowing what to do when…”). More broadly, your comment raises the question of what we should do when predatorial, criminal conduct coincides with general mental illness.

    Joshua's earlier comment implied that many of these women are sufferers from borderline personality disorder. Some researchers have wondered if most male inmates in prison suffer from a similar pathology. Order and justice may not be served either in an overly permissive (“slap on the wrist”) or overly persecutorial (“20,000 years in sing-sing”) approach. Perhaps a long-term forced medication would be a preferable solution for male sexual predators and female ones, too.

    Congrats on Norways (apparently) reasonable coffee tort laws. Not quite on the level of protection from sexual predators, but important nonetheless.

    Thank you both for your comments. Blogging is a great way to generate contradictory perspectives, which let us form analogies that let us see higher truths. I have written about this process before [1], and I value it. Thank you.

    Some have said that Elisabet Sunde is mentally ill. I believe that. Others have expressed sympathy to her victims I believe that too.

    Elisabet is a sexual predator. Women who falsely accuse men of rape are much more likely than others to do so again. Women like Elisabet have the power to ruin lives and cause real pain. Like pedophiles [2] they may not have the full ability to control their actions.

    This is why monitoring of and reporting on sexual predators like Ms. Sunde are so important. If this indeed a compulsive act, or part of her anxious response to a different environment, other men (and their families) may be victimized in the future. Just as parents of small children will steer clear of known pedophiles, men should have the knowledge to avoid Elisabet Sunde.

    In the United States, pedophiles have to self report themselves to their neighbors. This is not a form of punishment, but rather (as Connecticut Department of Public Safety v. Doe [3] and Smith v. Doe [4] established) a public health measure.

    I am less angry at Elisabet than I was when I penned this post, but much more worried. If her actions were out of simple malicious we could simply punish her. But as her actions appear to be from a similar neurobiological mechanism as predatory pedophiles, society's reaction must be much more expansive.


    PS: How did Elisabet escape the country? Did the local judge allow her to keep her passport?

  14. I'm not sure how she escaped…Maybe someone else know? I think that some of the rules in the US are wrong, like you can put teenagers on death row..I agree that men should know about what Elisabeth Sunde did, not that I think that she will do it again. But I think it's really stupid to put her adress on the internet.

  15. Elisabet Sunde was arraigned on April 4th, at 1:00 PM, in room 4-D. While she was not present (presumably she's already fled the country), her attorney pled not guilty for her in front of two different judges in open court (presumably, one judge for the misdemeanor drug charges, another for “providing false information” — which is all Florida can prosecute sexual predators like Elisabet under).

    The pretrial is set for 8:30 AM on Friday, April 28th on room 4-B. But (if she's fled the country) she probably won't be there.

    Norway, I'm glad that you believe others should know about Elisabet's past behavior. I think we agree that it's a public health issue.

I'm from her hometown, Bergen, and I will be extra careful next time I am out drinking and I see anyone with even a remotely resemblance to Sunde.
