2007 Dozier Internet Law Google Rankings – Week 4

This week’s poll is a tale of stability. Of the top 10 entry, only two are not holds. The biggest gainer is Plagiarism Today, which is apparently enjoying the popularity of a mention on Writing Thoughts. “PT” jumps 7 points to #6, while Blog of M’Gath gives way, falling 13 spaces to #18. Ars Technica is the other mover in the Top 12, jumping one position to #5.

Only one entry fell out of the Top 25: Jown W Dozier Jr’s blog. A discussion thread from Something Awful takes old #23 Dozier’s place and then some, standing tall at #12.

Because there are now only 3 Dozier-affiliated sites in the Top 25 (down from 4 in Weeks 3 and 2, and 7 in Week 1), only three pages are included in the “Others receiving votes” category. Of those three, one had dropped from the rankings last week, while the others received votes in the previous round.

2007 Dozier Internet Law Google Rankings – Week 3

This weeks poll includes the story of an upset worthy of Boston College. After seeing their FindLaw entry fall a point and a press release fall out of the Top 25 midweek, Dozier rallied to maintain the status quo by beginning of morning Wednesday. Though their eWorldWire fluff piece fall off the radar, John Dozier Jr’s rarely updated personal blog took its place at #23.

The major story is Gamespot, who’s apparently censored story on Dozier inexplicably makes the top 10. Early in the week, gamespot.com also made the Top 25, but finally collapsed. No Top 25 incumbent managed to rise more than one place: this accomplishment was shared by Blog of M’Gath, CLP, and Dreaming 5GW.

The biggest fall is J-Walk Blog, which fell from #13 to not even receiving votes. Of those that remain in the Top 25, I Hate Linux and ihatelinux.blogspot both fell 11 places. In fairness, however, CodePrairie .Net, which appears to be a spidered copying of the I Hate Linux properties, take up two of the four “others receiving votes” slots.

The urchinTracker() method: How Dozier Internet Law, PC’s website secretly spies on its visitors

Many web sites track or (to use a less friendly word) “spy”on their users. As tdaxp.com sits on top of blogspirit’s blog content system, I can view aggregate data about who is accessing my posts. Many other sites use SiteMeter or another third-party tool to get even more detailed information.

Some attempt to hide their espionage, however. One such good example is Dozier Internet Law, PC (a company which forbids hyperlinking). They forbid the “view source” option in a web browser that allows individuals to see what code is being activated by their presense. A view source on Slashdot‘s copy of their web code reveals the following

Curious about what this (I was inspired by Raise the Hammer‘s investigation) I searched, and found that it is part of Google Analytics:

Google Analytics’ urchinTracker allows you to track events on your site that do not generate a pageview. Using the urchinTracker JavaScript, you can assign a specific page filename to Flash events, JavaScript events, file downloads, outbound links, and more.

To be, this presents an ethical dilemma. Dozier eavesdrops on the browsers that visits it. Simultaneously, Dozier’s rules make it impossible to notice the eavesdropping while obeying its terms of use. I’m not sure what the ethics rules for “attorney advertising” (which Dozier’s website is classified as) are for lawyers in the jurisdiction where they operate, but I assume they do not encourage making informed consent impossible.

Dozier Internet Law censoring Gamespot?

When Informercial Scams was SLAPP’d by Dozier Internet Law, they contacted Public Citizen and fought back. But was GameSpot similarly targeted? And did they cave?

The mystery comes from the current #11 result for Dozier Internet Law, titled “GameSpot: Note to Dozier Internet Law: Don’t screw with ⁄.” Bizarrely, this high-ranking post reads:

Game over
This user is banned
No continues

However, google cache reveals this text (emphasis original):

Those guys (douchebags) everyone loves to hate at cybertriallaywers.com have just done something incredibly stupid…they’ve tried to claim copyright on their website’s HTML. Fresh off their embarassment at the hands of Public Citizen it was found out that in their website’s EULA they assert copyright over their website’s HTML.

Thats not the funny part though, that comes in the form of the comments on the Slashdot article about it.

Within the first handful of comments the HTML source had already been reproduced in full, analysed, found to be invalid HTML, oh and apparently that it violates copyright itself in at least two different ways.

In otherwords I would like to modify slightly that old saying, “Don’t fight the internet.” Don’t fight slashdot, you will lose and be humiliated in the process.

So did Dozier get to a description of a Slashdot article, but not the article itself? Did Gamespot ban the user and delete the post for another reason?

2007 Dozier Internet Law Google Rankings – Week 2

Intro: It’s been more than a week since my first Dozier Internet Law Top 25 Poll, but I figured if I was ever going to do another, the time is now. The format is based on the NCAA College Football polls. The first time a domain is in Google’s results, I use the proper name. If it appears a second time, I use the domain URL. As Dozier Internet Law’s terms of use appear to forbid hyperlinks, DIL and related properties are not linked. “Others receiving votes” shows the pages that would need to appear for each of the Top 25 positions ot be hyperlinked. “Dropped from rankings” shows that that appeared last time but not this time.

Up front: The top ten is relatively stable, which is predictable given that this is a well covered news story. 7 of the top 10 results are in the same place, while only two sites are new to the top 20 (and both of those were in the last week’s top 15). The real competition is at the bottom of the poll, with 7 of the second-rate pages (11-25) being new to the poll. Some sites have fallen dramatically, but none so much as Jim River Report and jimriverreport.com, which each fell 7 places. Of the four remaining pages that are favorable to Dozier Internet Law, FindLaw fell one place and eWorldWire fell three. While it is not surprising that 6 of the pages that fell out of the poll ranked 18 and below, the stunning drop of Slashdot from #7 to not even receiving votes represents a meltdown worthy of Bill Callahan.

"Scofflaw Bloggers:" The Dozier Taxonomy of Wicked Netizens

Dozier Internet Law is a “cyber law firm”that specializes in litigation related to the internet. For background, see the Cuppy’s Coffee and DirectBuy case studies. However, as “cyber lawyers” the guys at Dozier clearly pay a lot of attention to the internet, as well.

While John Dozier has a blog, he rarely updates it. Instead, he appears to use his company’s website to pen “news” entries. John’s last message allowed us to link to it. The current one, titled “Scofflaw Bloggers,” does not have such a “yes you may link to this page” notice. Therefore, links throughout this post to not go to any of John’s websites, out of respect for him, but rather other sources of information about the company.

“Scofflaw Bloggers” provides a taxonomy of “persona[e] and motivation[s]” that have “arisen and infiltrated the mainstream blogosphere” since CDA SS 230. The post appears to be in reaction to criticism of Dozier from internet news sources (Ars Technica, Boing Boing, Patry, Esq, Public Citizen, Slashdot, Turkewitz, Esq, etc.). The ten types, a brief quote from Dozier’s descriptions, the qualities described, and a commentary as to whether they fit me are included below.

    Description: “This blogger has a hidden agenda, but he just makes it sound like he is a totally objective commentator.”

    Qualities:

    Does it fit tdaxp?: I’d like to think this blog appears to be respectable, but I have no advertisers and have only received a couple of books and a couple interesting rl conversations out of it.

  • Name: Criminal

    Description: “Career criminals, no less”

    Qualities:

    • $0.5M/year pay-offs
    • Guard dogs surround compound
    • Highly effective operational plan

    Does it fit tdaxp?: I eat Ramen way too often to earn six figures, or to have a compound,

  • Name: Bankrupt

    Description: “This is usually not a smart guy”

    Qualities:

    • No money
    • No assets
    • No prospects for work

    Does it fit tdaxp?: I have to say, the very qualities which make me not a “criminal” appear to make me “bankrupt.” (I hope I am a smart guy, however.)

  • Name: Sadist

    Description: “most likely to be the one that starts recommending direct physical violence against the exeutives of a company”

    Qualities:

    • Escalates attacks rapidly
    • Uses his real name
    • Enjoys inflicting pain

    Does it fit tdaxp?: Well, I am in my fifth year of graduate school, but that would make me a masochist, not a sadist. I blog pseudo-anonymously and haven’t recommended direct physical violence yet, however, so this doesn’t quite conform

  • Name: Rookie

    Description: “just kids having fun as the hormones kick in”

    Qualities:

    • Mimic adult conversation
    • Spell “ROI” as “RIO”
    • Can be utterly immature

    Does it fit tdaxp?: I like to use big words and misspell short ones, but I’m rarely charged with immaturity. No only 2 for 3 (hopefully!)

  • Name: Nerd

    Description: “scared to talk with a girl”

    Qualities:

    • no principles involved
    • posts are intelligent and have face validity
    • cowers once identified

    Does it fit tdaxp?: Hmmm… certainly this blog looks smart, but tends to a coherent aesthetic-politico-religious framework (the old tagline of tdaxp was “Beauty, Victory, God”). I guess the test will be if tdaxp folds up shop once someone calls me a nerd. (I’ve kept going through death threats, but those are adreneline-boosting, I guess.)

  • Name: Alien

    Description: “from overseas”

    Qualities:

    • Non US- resident
    • Works with criminals
    • Sometimes nabbed by the FBI in Turkey

    Does it fit tdaxp?: I’m an American, don’t know anyone with guard dogs surrounding his compound, have no plans of visiting Turkey, and no plans of evading the FBI there.

  • Name: Druggie

    Description: “during the day this blogger is a normal guy”

    Qualities:

    • Suffers from amnesia
    • Substance abuser
    • “Hooks up” on the net

    Does it fit tdaxp?: I don’t rember forgetting (but then how would I??), drink modesty (but isn’t that how it starts??) and already hooked up with my knife (but what I convert to a polygamic faith??)

  • Name: Pickpocket

    Description: “enjoys attacking defenseless people”

    Qualities:

    • Steals copyrighted material
    • Extracts revenues from ads
    • Uses meta tags

    Does it fit tdaxp?: “Pickpocket” appears to be a combination of “Criminal” and Sadist,” making both necessary conditions for pickpockethood.

  • Name:Wacko

    Description: “Most sophisticated business people immediately view the post as a ‘nut case’”

    Qualities:

    • Begins with fair criticism
    • Invests time into he criticism
    • Multiple web properties

    Does it fit tdaxp?: Well.. maybe

    I have multiple web properties. Besides tdaxp, my South Dakota focused news aggregator is covering the story, and using blospirit’s point-and-click interface I began Dozier Internet Lawsuits to try to keep tabs on the company. (I only have two posts, because I would like any record to be even-handed, and I’ve been able to identify only one Dozier victory and many defeats.) Additionally, I use del.icio.us social bookmarks, so there’s that, too.

    I have spent time on this. Part of the reason is that I dislike censorship, and another (less noble) is that I have empty time I want to fill. (Now, for example, I am riding with my wife on I-80 through scenic if empty western Illinois.)

    My criticism has been fair. Again, check out my description of the DirectBuy case, and the earlier Franchise Time article on Cuppy’s Coffee. While I have more pointed possibilities as well, such as questioning the motive Dozier attorney Donald Morris or Dozier’s history of disrespecting online privacy, I immediately received positive feedback on both topics.

I think John Dozier called me a Wacko.

Dozier Internet Law did it again.

In over three years of blogging, I have never been featured on Slashdot. But Dozier has, twice, in less than a month. On October 8th and October 18th.

Again the blogosphere’s reaction has been overwhelming. (Keeping track of this is the most exhausting part of reporting on Dozier’s adventures.) The latest Slashdot story has been picked up in English by astroaztec, Curtis Schweizter, deek, Geek Feeder, hackd, and Tech Blogger.

John C. Dvorak on Dozier Internet Law

John C. Dvorak is a big name in technology analysis. I remember reading his columns in PC Magazine (he had two every issue) and watching him on CNET (the television show, not the website) before I even had a computer. So it’s especially pleasing that Dvorak links to Techdirt and Public Citizen in a post about Dozier Internet law.

A new invitation for Dozier Internet Law

At http://www.cybertriallawyer-sucks.com/, is the latest inivtation for Dozier Internet Law to test it’s strange interpretation of free speech rights. While not as sublte as similar efforts by Public Citizen, I Hate Linux, or whatithink, or as intellectual as Bill Patry (Google’s copyright big-wig)’s take, the site is nonetheless another follow-up to Dozier’s strange lawsuits on behalf of DirectBuy and Inventor-Link.
